1. The Artist shall consign original works of art to the Gallery, which the Gallery shall make its best efforts to sell. A list of the original works of art to be consigned is attached and includes dimensions, media, descriptive information and recommended retail prices.
2. All items shall remain the property of the Artist until sold. A label will be affixed to each piece of artwork identifying it as the property of the Artist and as being on consignment.
3. The Gallery agrees to sell all consigned artwork at the listed retail price with the following exception: a 10% discount may be given a buyer as an inducement to buy without consulting with the Artist, with the Gallery and the Artist both sharing in the discount equally. Note - this is a problematic statement, inviting the gallery to pay you 10% less on everything. What works better is to have the gallery mark the price up an additional 10%, then if they can sell it for more, they keep the 10%, and if they have to give a discount, they give up their 10%, not yours.
4. The Gallery owner shall retain _______% and pay the Artist _______% of the retail price agreed upon for each item consigned by the artist to the gallery. Payment shall be due by the 15th day of each month for items sold the previous month.
5. The Artist may pick up any unsold items one month from the date of this Agreement upon giving the Gallery ten (10) days written notice. If payment for items sold is not made when due, the artist may remove the consigned artwork any time after the payment due date without notice.
6. The Gallery may notify the artist to remove any or all items for any reason. The Gallery agrees to store and protect the consigned items for a period of 120 days from the date the Gallery notifies the artist.
7. The Gallery will be liable for loss or damage to all items while in the Gallery's possession. This damage shall be limited to the money due the artist if the items had sold.
8. The Artist shall retain all right of copyright pertaining to reproduction of the artwork. The sale of an artwork does not affect the Artist's ownership of copyrights.
9. Whereas reasonable people will make every effort to resolve disputes amicably through normal modes of communication, in the event of irresolvable disputes, the signatories agree to submit themselves to the jurisdiction and legal venue of the county and state of residence of Your Name. By signing below, we indicate our agreement to the above conditions and clauses.
